Membership Agreement
1- This Membership Agreement is concluded to determine the rules and conditions for the use of the www.orkaholidays.com website by Orka Better Homes Turkey İnşaat Emlak Turizm ve Ticaret LTD. Sti. and its affiliates (hereinafter to be referred to as Orka Holidays).
2. ORKA HOLIDAYS will regularly send the campaigns and announcements to the members who have approved the Agreement and ensures them to make online reservations and rentals.
3- The website www.orkaholidays.com is personal, non-transferable or non-sellable.
4- The member shall have a "password" that he or she determines. User can change password whenever he wants. ORKA HOLIDAYS has taken all precautions about membership safety. Members are also responsible for membership safety. ORKA HOLIDAYS does not request password information from its customers. Www.orkaholidays.com is not responsible for any problems caused by password usage.
The e-mail address you give at registration stage is specific to the member and has the opportunity to create a single membership; you cannot have two different memberships with the same e-mail address. "Password" is only known by the user.
The user must enter his e-mail address and password during signing in to be able to connect to the services requiring membership.
5- The Member agrees to be contacted by www.orkaholidays.com with the purpose of submitting campaign applications through personal and shopping information he gives to www.orkaholidays.com.
6. Member agrees that he is solely liable for any incomplete or inaccurate information that he provided while being a member of www.orkaholidays.com and in case of inaccurate information or breach of this agreement Orka holidays is entitled to terminate its membership without the need for any prior authorization or notice unilaterally.
7- Member agrees and undertakes not to use, reproduce, publish or sell any information, documents, software, designs, graphics, texts, visuals, videos, content, works etc. belonging to ORKA HOLIDAYS or content of this website.
8- www.orkaholidays.com may temporarily suspend or stop the operation of the system temporarily at any time. ORKA HOLIDAYS will have no liability against members or third parties due to temporary suspension or complete suspension of the system or www.orkaholidays.com.
www.orkaholidays.com may prevent the member from entering the system or receiving a new password without specifying any reason even if member has entered the username and password correctly.
www.orkaholidays.com owns copyright and intellectual property rights for any works, information, documents, software, design, graphics etc. that are produced and / or purchased from outside.
Www.orkaholidays.com's sales are limited to villa availability and villa suitability.
Www.orkaholidays.com may not make deliver key for villas that are not available, cancel the reservation & rent and return the order payment amount to the account of the client.
The listing of the products in the virtual system does not necessarily mean that the villas are necessarily located on www.orkaholidays.com or ORKA HOLIDAYS system.
Documents, software, design, graphics, etc. that the produced by members and uploaded to system voluntarily cannot be used without permission.
The right to change price and product specification information for products offered for sale at www.orkaholidays.com is exclusively owned and reserved by www.orkaholidays.com. If there is a mistake in the price and product specification information, www.orkaholidays.com can correct the error and deliver the villa key or cancel the booking & renting and refund the order amount paid by customer to the customer account with exclusive right of selection any of these two options reserved by Orka.
Www.orkaholidays.com, can provide access to other websites for member. In this case www.orkaholidays.com is not responsible for the content of the sites that the member will directs.
ORKA HOLIDAYS may make changes in the implementation of this agreement for future technical requirements and legislative harmonization or modify existing materials or add new materials. Www.orkaholidays.com may change some services not requiring membership to a status that require membership, open additional services, change some services in whole or in part, or convert them to a fee-based service.
9- The Member agrees and undertakes that the records, microfilm, microfiche and computer records of ORKA HOLIDAYS shall constitute the substantive, binding, definitive and exclusive evidence in the meaning of Article 193 of the HMK and that this is the an evidence contract between parties. Member agrees, accepts and undertakes to waive to offer oath and rejection related to any records of ORKA HOLIDAYS and that these records are kept duly.
10- In the disputes that may arise in relation to this agreement, firstly the provisions in this agreement and in the cases where there is no provision, the current Turkish legislation shall apply.
11- FETHIYE Central Courts and Executive Directorships shall be authorized to resolve any disputes arising from the application of this contract.
12- After the member has completed the registration form and received the password, this contract enters into force for indefinite time between the parties.
13- When ORKA HOLIDAYS wishes may terminate unilaterally this agreement.
